Selling a junk car that still has a loan on it

Can you junk a car that still has a loan in Illinois?
Not until the lien is cleared. The lender's interest is on the title, so the loan is paid off first and the lender releases the lien, which Illinois law requires within 21 days of payment. After that, S & H Cash for Junk Cars Corp. can buy the car from Markham or a nearby suburb and pay you at pickup.
A car loan outlives plenty of cars. A crash, a dead transmission or a flood can leave you making payments on something that’s sitting in the driveway. You can sell it, but the order matters: the lien comes off first, then the sale.
Why the lien comes first
When you finance a car in Illinois, the lender is recorded on the title as the lienholder. Until that interest is released, you can’t hand a buyer a clean title, and a scrap buyer needs a document that shows you own the car outright. The payoff itself is between you and the lender.
The steps
- Ask the lender for a payoff quote. Get the exact amount and the date it’s good through.
- Pay it. If speed matters, pay by cash, cashier’s check or certified check. That shortens the lender’s deadline (see below).
- Get the release. The lender releases its security interest and, if it holds a paper title, mails the title and release to you.
- Get a clean title if you want one. Illinois lets you send the title and release to the Secretary of State with an application and fee for a new title showing no lien.
- Sell the car. With the title and the release in hand, the sale works like any other: free towing, payment at pickup.
The deadlines lenders have to meet
625 ILCS 5/3-205 sets them:
| How you paid off the loan | Lender’s deadline to release |
|---|---|
| Personal check, transfer, regular payments | 21 days after receiving payment |
| Cash, cashier’s check or certified check | 10 business days |
If the lender misses the deadline, the same section makes it liable for $150 plus reasonable attorney fees and court costs, and says the claim can be brought in small claims court. Separately, 625 ILCS 5/3-114 makes it unlawful for a lienholder holding a title to refuse to deliver it once the lien is satisfied.
Electronic titles
Illinois is moving lenders to electronic lien and titling (ELT). In a February 11, 2026 release, the Secretary of State said all financial institutions that process five or more liens a year in Illinois must use ELT by July 1, 2026, and that when a loan is paid off, lenders can release the title instantly. If your lender uses ELT, ask how they’ll deliver the released title to you, since there may not be a paper title in a drawer somewhere.
A paid-off loan, but the title still shows the lender
This happens with older loans. The SOS paid-off-loan checklist asks whether the lender sent the title signed off as satisfied, or a lien satisfaction letter on its letterhead. Keep that letter with the title. If the title itself is lost too, the duplicate-title process accepts a lien clearance letter, explained in replacing a lost Illinois title.
Underwater on a wreck
If the car was in an accident and you carry collision coverage, talk to your insurer before you do anything else. If the insurer totals the car, ask how it will settle with the lender, since the car often goes to the insurer. If you keep the car, the lender still has to be paid off before it can be sold. Our wrecked car page covers what happens after a claim.
Once the paperwork is clean, the rest is quick. What happens after you sell explains the plates, the Seller’s Report of Sale and cancelling insurance.
Quick answers
- How long does a lender have to release the lien in Illinois?
- 21 days after receiving payment, or 10 business days if you paid by cash, cashier's check or certified check, under 625 ILCS 5/3-205.
- What if the lender is late?
- The statute makes a late lienholder liable for $150 plus reasonable attorney fees and court costs, and says the claim can go to small claims court.
- The car is worth less than I owe. What now?
- The lender still has to be paid before the lien is released. Ask the lender for your exact payoff figure and how they handle a payoff for a car that's being scrapped.
