Got a notice about an inoperable car? What south suburban codes say

By S & H Cash for Junk Cars Corp. · Last updated October 21, 2026

What counts as an inoperable vehicle in Illinois?

Under Illinois law (65 ILCS 5/11-40-3), an inoperable motor vehicle is one with the engine, wheels or other parts removed or damaged for at least 7 days, or a longer period set locally, so it can't be driven under its own power. Towns can declare one a nuisance if it's in public view. S & H Cash for Junk Cars Corp. buys and tows these cars from Markham-area towns.

A notice on the door or a sticker on the windshield usually means the clock has already started. The good news is that every one of these rules ends the same way: once the car is gone, the problem is gone. This guide explains what the state allows towns to do and what each town near us has written into its code.

The state rule behind the local ones

Illinois lets cities and villages deal with inoperable cars by ordinance. Under 65 ILCS 5/11-40-3, a municipality “may by ordinance declare all inoperable motor vehicles, whether on public or private property and in view of the general public, to be a nuisance,” and can have police remove one 7 days after the municipal notice.

The statute’s definition is worth reading closely. An inoperable motor vehicle is one “from which, for a period of at least 7 days or any greater period fixed by ordinance, the engine, wheels or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own motor power.” A car temporarily laid up for ordinary service or repair doesn’t count.

The same section exempts vehicles “kept within a building when not in use,” operable historic vehicles over 25 years old, and vehicles on the premises of a business engaged in wrecking or junking.

Separately, the Illinois Vehicle Code makes abandoning a vehicle on private or public property in public view unlawful, except on the owner’s own property, and allows police to authorize removal after 7 days (625 ILCS 5/4-201).

Town by town

Each town can tighten the state rule, and several have. This table summarizes the local codes for the ten towns we cover. Follow the link for your town’s exact text.

Town What the code says Deadline after notice or condition
Markham Inoperable vehicle in public view on private property is a nuisance (§ 90.01) Parts removed or disabled 7+ days
Harvey Inoperable includes no current plate; one per home, in a garage (Ch. 10-76) 72 hours on the street, 7 days on private property
Posen Junked or nonoperating vehicle on private premises is a nuisance (§ 10-14A-2) More than 10 days
Hazel Crest Inoperable vehicles may not be left on streets or in driveways (village page) 7 days to request a pre-tow hearing
Country Club Hills Parts removed or damaged, or can’t run; tarps don’t cure it (Sec. 6.2.03) 48 hours; 30 days if you’re selling it
Oak Forest Abandoned includes no current license or inoperative, in public view (§ 132.11) 7 days after a warning
Homewood Storing an inoperable vehicle on any premises is a nuisance; move it into a closed garage (§ 40-40) Inoperable 7+ days, then written notice
Flossmoor In public view is a nuisance; a tarp doesn’t hide it (Art. 9) 7 days after notice
Matteson Wrecked, inoperative or junked vehicle stored outside (§ 90.16) More than 72 hours
Richton Park Nuisance unless moved to legal storage (§ 422.03) 10 days after notice

A pattern shows up: plates matter. Harvey, Oak Forest, Matteson and Country Club Hills all treat a car without current plates or registration as part of the problem, not just one that won’t run. A car that runs fine but has sat for a year on expired plates can still draw a notice.

What to do when you get a notice

  1. Read the date. Work out the deadline from the notice and your town’s rule.
  2. Decide fix or sell. If a cheap repair gets it running and you’ll renew the plates, do that. If not, selling is usually faster than any repair.
  3. Don’t move it to the street. Every town on the list has street rules (overnight bans, snow rules, plate rules) that make a dead car on the street a quicker tow, not a slower one.
  4. Call before the deadline. We tow for free, often on the day you call, and pay you before the car leaves.
  5. Keep proof. After the sale, keep a copy of the signed title and file the Seller’s Report of Sale with the Secretary of State. What happens after you sell explains it.

If the city tows it first

An impounded car costs money to get back. Markham, for example, sets an impound release fee under § 90.37, and storage adds up from there. If the car was going to be scrapped anyway, it’s almost always better to sell it before the tow. If the city already has it, the owner usually has to get it released before it can be sold.

What happens to the car after

Once we buy it, the car is towed and recycled: fluids drained, battery and tires handled under their own rules, and the steel shredded. How junk car recycling helps the environment covers each step. For a car that won’t start, see cars that don’t run.

Local codes change. The table reflects the published code text we read in October 2026. It isn’t legal advice, and your village hall can confirm what applies to your property.

Quick answers

Does putting a cover over the car solve the problem?
Not in Flossmoor or Country Club Hills. Both codes say a tarp doesn't take the car out of public view or cure the violation. Check your own town's code.
Is a car in my garage exempt?
Under the state law and most local codes, a vehicle kept inside a building is exempt. Harvey limits a home to one inoperable or unregistered vehicle, and it must be in a garage or enclosure.
What if I'm planning to sell the car?
Country Club Hills gives an owner who is selling the car 30 days after notice. Elsewhere, selling it before the deadline is usually the quickest fix, and a same-day pickup is often possible.
